Terms & Conditions
The following terms and conditions shall form part of this student contract entered into between The Keys Academy Group Pte. Ltd. (“The Keys Academy” or the “school”) and me, being the parent/legal guardian (the “parent”) of the student named in this registration form completed by the parent (the “student”).
1.1 I consent to the school taking the student out of the school’s premises on field trips as part of the program of The Keys Academy Holiday Camp (the “Camp”). I understand that this will require the student to be away from the school’s premises for the period of each field trip.
1.2 I have provided all information regarding the student’s allergies and consent to the school providing meals for the student.
1.3 I authorize the school to act on my behalf to arrange any medical treatment as may be deemed necessary for the student in case of emergency. I also undertake to pay any medical costs which may be incurred for such treatment, including the costs of ambulance transport and medication.
Camp fees paid are strictly non-refundable and non-transferable.
The school reserves the right to re-schedule any or part of the programs of the Camp at its discretion prior to the commencement of such programs. The school will inform the student and the parent of any re-scheduling of programs.
4. Use of Likeness / Intellectual Property
4.1 The school and its authorised representatives, agents, affiliates, subsidiaries, licensees, successors and assigns shall have the sub-licensable right and license to record, photograph, and otherwise capture the student and/or the parent, and the right and license to use any photographs and recordings in which the student’s and/or the parent’s likeness may appear in, and to use, the student’s and/or the parent’s voice, likeness, picture, interviews, academic results and written work and to extract and use any statements the student and/or the parent makes as quotations (the “Likeness”).
4.2 No fees, royalties or any other sums shall be due to the student and/or the parent, and the school shall not be obligated to pay the student, the parent or any third party any fees, royalties or any other sums whatsoever for the use of the Likeness.
4.3 Any copyright, patent, utility model, design, trade mark, applications for the same and other similar kinds of intellectual property rights in Singapore or elsewhere in the world arising from the materials and documents provided during the camp shall remain the property of the school. The student may use such materials and documents only for the sole purpose of the Camp. Any reproduction, distribution or disclosure of such materials and documents without the prior written consent of the school is strictly prohibited.
5. Personal Data Protection
The school’s personal data protection policy (please see next page) shall form part of these terms and conditions, and the parent agrees on their own behalf and on behalf of the student to the collection, use and disclosure of their personal data as described in the personal data protection policy.
6. Risk and Liability Policy
6.1 To the fullest extent permitted under applicable law and subject to paragraph 6.3 below, the school, its legal representatives, officers and employees (collectively, “Representatives”) shall not be liable or held responsible for any losses, damages, costs or expenses (including, without limitation, any direct, indirect or consequential losses) which may be incurred by any person or any personal injury or death of any person, in each case, which may arise as a result of, or in connection with the Camp, the student contract and/or use of the school’s premises by the student and/or the parent and/or any other third party.
6.2 Notwithstanding paragraph 6.1 above and subject to applicable law and paragraph 6.3 below, in no event shall the aggregate liability of the school and its Representatives exceed the amount of the fees actually paid by the parent under this student contract.
6.3 Paragraphs 6.1 and 6.2 above shall not apply to any personal injury or death arising from the negligence of the school or its Representatives.
6.4 The parent shall indemnify the school for all losses, damages, expenses or other liability incurred by the school as a result of any damage or other liability to public and/or private property caused, or alleged to be caused by the student and/or the parent.
7. Other Student Contracts
For the avoidance of doubt, this student contract shall not affect any other student contract entered into between the parent and the school, whether in relation to the student’s enrolment in any course operated by the school or otherwise, which shall remain in full force and effect.
